What compensation does and does not cover
Workers' compensation in New York pays for medical treatment and a portion of lost wages for a work injury, regardless of who was at fault. In exchange it is generally your exclusive remedy against your employer — and it does not pay for pain and suffering.
That last point is why the second question always matters: was anyone other than your employer involved? A negligent driver, a property owner, a general contractor, an equipment manufacturer. A claim against a third party is separate from compensation, is not subject to the exclusive remedy rule, and can include the damages compensation leaves out.
The deadlines are strict and short. Written notice to your employer within 30 days, and a claim filed with the Board generally within two years. Report the injury in writing even if you think it is minor, and make sure the medical record says it happened at work.

How long you have to file
Give your employer written notice within 30 days and file a claim with the Workers' Compensation Board generally within two years of the injury or of when you knew it was work-related. Any third-party claim follows its own deadline, usually three years, and a claim involving a public body may require a notice of claim within 90 days. These run in parallel and are easy to conflate.
Common questions
Can I be fired for filing a claim?
Retaliating against an employee for claiming workers' compensation is prohibited in New York. If it happens, that is a separate matter and worth raising with us.
Does my immigration status affect my benefits?
Workers' compensation benefits in New York are generally available regardless of immigration status.
My claim was denied. Is that the end?
No. Denials are common and are frequently reversed. There is a hearing process, and having representation at it matters.
Can I sue my employer as well?
Usually not — compensation is generally the exclusive remedy against an employer. The exception that matters is a claim against someone else whose negligence contributed, which is separate and can include pain and suffering.
