The injury insurers most often dispute

Traumatic brain injury is the injury most commonly argued about, because a mild TBI often does not show up on a routine CT or MRI. An insurer will point at a clean scan and say nothing is wrong, while the person living with it is struggling with memory, concentration, mood, light sensitivity and fatigue.

What answers that is the right evidence: neuropsychological testing, specialist neurological assessment, and — crucially — accounts from the people around you. Family, colleagues and friends noticing changes in someone's personality, patience or reliability is often the most persuasive material in the file.

Loss of consciousness is not required for a brain injury. Report every symptom to your doctors, even ones that feel unrelated or embarrassing, and do it early. Gaps and understatement in the medical record are the two things that cost these claims most.

How Davidov & Cohen can help

We take the administrative weight off you and put the case on a footing where the other side has a reason to deal with it properly.

01

We build the medical picture properly

Neuropsychological testing and specialist assessment, not just the emergency room scan an insurer will point to.

02

We gather the before-and-after evidence

Accounts from family, colleagues and friends about what has changed. In a brain injury case this is often the most persuasive material there is.

03

We cost the long-term effect

Cognitive injury affects earning capacity and independence for years. That needs proper assessment rather than a round number.

04

We prepare it as a trial case

Most claims settle. They settle for more when the file is built as though it will be tried, and the other side knows it.

How these injuries happen

  • Motor vehicle collisions
  • Falls from height
  • Falls on stairs and walkways
  • Construction site accidents
  • Struck by falling objects
  • Pedestrian and cyclist collisions
  • Assaults and inadequate security
  • Sports and recreation injuries
  • Bicycle and scooter crashes
  • Near-drowning and oxygen deprivation
  • Birth-related brain injury
  • Medical negligence

How long you have to file

In New York the general deadline for a personal injury claim is three years from the date of the injury. Several exceptions are much shorter — a claim against the City, the MTA or another public body usually requires a notice of claim within 90 days, and wrongful death has its own two-year limit. Because the short deadlines are the easy ones to miss, it is worth a call early even if you have not decided whether to bring a claim.

Common questions

My scan was normal. Do I still have a claim?

Yes, potentially. Mild traumatic brain injury frequently does not appear on routine imaging. Neuropsychological testing and specialist assessment are usually what establishes it.

I never lost consciousness.

Loss of consciousness is not required for a traumatic brain injury, and many significant injuries occur without it.

My symptoms started weeks later. Does that hurt my case?

Delayed presentation is common and well recognised medically, but it does give insurers something to argue about. Reporting symptoms to a doctor as soon as you notice them is the best answer.

The insurer already offered me money. Should I take it?

Speak to a lawyer first. Early offers usually arrive before the full extent of an injury is known, and accepting one normally means signing a release that ends the claim — including for treatment you have not had yet.

What does it cost to hire you?

Nothing up front. We work on a contingency fee, so our fee comes out of a recovery and there is no fee if there is no recovery. The consultation is free.
