Pedestrians struck by a vehicle are covered by that vehicle's no-fault insurance.

What a pedestrian claim involves

A pedestrian struck by a motor vehicle in New York is generally covered by that vehicle's no-fault insurance for medical treatment and part of their lost earnings, regardless of who was at fault. The application deadline is 30 days from the date of the accident.

A separate claim against the driver covers pain and suffering, and in most cases has to meet the serious injury threshold. Pedestrian injuries are often severe enough to qualify, but the case still rises or falls on the record.

Drivers in New York must exercise due care to avoid a pedestrian regardless of who had the signal, and there are specific rules about yielding in crosswalks. Even where a pedestrian crossed outside a crosswalk, comparative negligence apportions the fault rather than ending the claim.

How Davidov & Cohen can help

We take the administrative weight off you and put the case on a footing where the other side has a reason to deal with it properly.

01

We deal with the insurers

Every call, form and deadline runs through us. You stop fielding adjusters and can concentrate on getting better.

02

We preserve the evidence early

Records, photographs, camera footage and witness accounts. Footage is often overwritten within days, so this starts immediately.

03

We document the full injury

We work with your treating doctors, and specialists where a case calls for one, so the record reflects what the injury actually costs you.

04

We prepare it as a trial case

Most claims settle. They settle for more when the file is built as though it will be tried, and the other side knows it.

Pedestrian cases we handle

  • Struck in a marked crosswalk
  • Hit by a turning vehicle
  • Struck at an intersection
  • Backing and parking lot collisions
  • Hit by a bus or truck
  • Struck by a delivery vehicle
  • Rideshare and taxi collisions
  • Hit and run
  • Injuries on or near a construction site
  • Struck on a sidewalk
  • Collisions involving e-bikes and scooters
  • Children and older pedestrians

How long you have to file

In New York the general deadline for a personal injury claim is three years from the date of the injury. Several exceptions are much shorter — a claim against the City, the MTA or another public body usually requires a notice of claim within 90 days, and wrongful death has its own two-year limit. Because the short deadlines are the easy ones to miss, it is worth a call early even if you have not decided whether to bring a claim.

Common questions

I was crossing outside the crosswalk. Do I still have a claim?

Possibly. It is likely to reduce your recovery under comparative negligence, but drivers still owe a duty of care to avoid pedestrians, and being outside a crosswalk does not by itself end a claim.

The driver said I stepped out suddenly. What now?

That is a common account and it is exactly why independent evidence matters — camera footage, witness statements and the physical evidence at the scene. We work to obtain those before they disappear.

The insurer already offered me money. Should I take it?

Speak to a lawyer first. Early offers usually arrive before the full extent of an injury is known, and accepting one normally means signing a release that ends the claim — including for treatment you have not had yet.

What if I was hit by a City bus or a municipal vehicle?

Those claims usually require a notice of claim within 90 days, which is far shorter than the ordinary deadline. If a public vehicle was involved, act quickly.

What does it cost to hire you?

Nothing up front. We work on a contingency fee, so our fee comes out of a recovery and there is no fee if there is no recovery. The consultation is free.
