Why truck cases are different
A collision with a commercial truck is not simply a bigger car accident. Interstate carriers are governed by federal safety regulations covering driver hours, medical certification, maintenance and loading, and a violation of those rules can establish negligence directly.
These cases also generate evidence that ordinary crashes do not: electronic logging device data, engine control module downloads, dispatch records, inspection and repair histories, and drug and alcohol testing records. Carriers are only required to keep some of that for limited periods, and it can be lawfully destroyed on schedule unless a preservation demand is made.

How long you have to file
In New York the general deadline for a personal injury claim is three years from the date of the injury. Several exceptions are much shorter — a claim against the City, the MTA or another public body usually requires a notice of claim within 90 days, and wrongful death has its own two-year limit. Because the short deadlines are the easy ones to miss, it is worth a call early even if you have not decided whether to bring a claim.
Common questions
Why does it matter that it was a commercial truck?
Because federal regulations apply on top of ordinary negligence rules, and because commercial policies are usually larger. It also means there is documentary evidence — logs, telematics, maintenance records — that does not exist in a car case.
The trucking company's investigator called me. Should I speak to them?
Be careful. Carriers often send an investigator to the scene within hours, and their job is to limit the company's exposure. You are not obliged to give a recorded statement, and it is usually better to speak with your own lawyer first.
The insurer already offered me money. Should I take it?
Speak to a lawyer first. Early offers usually arrive before the full extent of an injury is known, and accepting one normally means signing a release that ends the claim — including for treatment you have not had yet.
What if the accident was partly my fault?
New York uses pure comparative negligence. Your compensation is reduced by your share of the fault rather than barred outright, so even someone substantially at fault may still recover. It is worth having someone look at it before you assume otherwise.
