Who insures a taxi, and what that means

Licensed New York taxis and for-hire vehicles carry commercial insurance, and passengers are generally entitled to no-fault benefits for medical treatment and part of their lost earnings, with the usual 30-day application deadline.

Ownership is often more complicated than it looks. The driver may lease the vehicle, the medallion may be held by a corporation, and the insurance may sit with an entity you never dealt with. Identifying the right parties early affects what coverage is available.

Get the medallion or licence number, the driver's name, and a copy of the trip record if you can. If you booked through an app, the electronic record of the trip is useful evidence and worth saving.

How long you have to file

In New York the general deadline for a personal injury claim is three years from the date of the injury. Several exceptions are much shorter — a claim against the City, the MTA or another public body usually requires a notice of claim within 90 days, and wrongful death has its own two-year limit. Because the short deadlines are the easy ones to miss, it is worth a call early even if you have not decided whether to bring a claim.

Common questions

I was a passenger. Do I have to prove who was at fault?

For no-fault benefits, generally no — they are payable regardless of fault. A claim for pain and suffering does depend on fault, but as a passenger you are rarely the one blamed.

The driver said it was the other car's fault. Does that matter to me?

As a passenger you can usually claim against whichever driver was responsible, and often against both while that is worked out. You are not required to resolve their dispute first.

The insurer already offered me money. Should I take it?

Speak to a lawyer first. Early offers usually arrive before the full extent of an injury is known, and accepting one normally means signing a release that ends the claim — including for treatment you have not had yet.

What if the accident was partly my fault?

New York uses pure comparative negligence. Your compensation is reduced by your share of the fault rather than barred outright, so even someone substantially at fault may still recover. It is worth having someone look at it before you assume otherwise.
