What to do after a crash in New York
Get medical attention first, even if you feel able to walk away. Neck, back and head injuries often present hours or days later, and a gap between the crash and your first medical record is the single most common thing an insurer uses to argue you were not badly hurt.
New York is a no-fault state. Your own insurer generally pays your initial medical bills and part of your lost earnings regardless of who caused the crash, but the application has a strict deadline — 30 days from the date of the accident. Missing it can cost you those benefits entirely. No-fault does not cover pain and suffering; a claim against the at-fault driver is separate, and in most cases requires a "serious injury" as New York defines it.
If you can do so safely, photograph the vehicles, the street, the traffic controls and your injuries, and get the names of any witnesses. You are not required to give a recorded statement to the other driver's insurance company, and it is usually better not to before speaking with a lawyer.

How long you have to file
In New York the general deadline for a personal injury claim is three years from the date of the crash. There are important exceptions that are much shorter — a claim involving a city vehicle or the MTA usually requires a notice of claim within 90 days, and wrongful death has its own two-year limit. Because the shorter deadlines are easy to miss, it is worth a call early even if you are not sure you want to bring a claim.
Common questions
Do I have a case if the crash was partly my fault?
Possibly. New York uses pure comparative negligence, which means your compensation is reduced by your share of the fault rather than barred outright. Even a driver found substantially at fault can recover something, so it is worth having someone look at it before you assume otherwise.
What does "serious injury" mean in a New York car accident claim?
It is a threshold in the no-fault law that a claim against the at-fault driver generally has to meet before you can recover for pain and suffering. The statute lists categories including fracture, significant disfigurement, permanent limitation of a body organ or member, and a substantial disability for 90 of the 180 days after the crash. Whether an injury qualifies is a common point of dispute, and it turns on the medical record.
The other driver's insurer offered me money already. Should I take it?
Speak to a lawyer first. Early offers usually arrive before the full extent of an injury is known, and accepting one normally means signing a release that ends the claim — including for treatment you have not had yet.
What if the driver had no insurance?
You may still have a route to recovery through the uninsured or underinsured motorist coverage on your own policy, or on a policy in the household. These claims have their own notice requirements, so they need attention early.
