How long you have to file
In New York the general deadline for a personal injury claim is three years from the date of the injury. Several exceptions are much shorter — a claim against the City, the MTA or another public body usually requires a notice of claim within 90 days, and wrongful death has its own two-year limit. Because the short deadlines are the easy ones to miss, it is worth a call early even if you have not decided whether to bring a claim.

Does no-fault cover an e-scooter rider?
It depends heavily on whether a motor vehicle was involved and on the classification of the device. Where a car or truck struck you, that vehicle's coverage will often respond. Where no motor vehicle was involved, it usually will not, and other routes have to be considered.
I was hurt on a rented scooter. Does the rental agreement stop me?
Rental agreements often contain waivers, but a waiver does not automatically defeat a claim — particularly where a mechanical defect or inadequate maintenance is involved. It is worth having the agreement reviewed rather than assumed.
A scooter hit me while I was walking. Who do I claim against?
Usually the rider, and depending on the facts potentially the rental operator. Identifying the rider is the first hurdle, which is why camera footage matters.
What if the accident was partly my fault?
New York uses pure comparative negligence. Your compensation is reduced by your share of the fault rather than barred outright, so even someone substantially at fault may still recover. It is worth having someone look at it before you assume otherwise.
