Motorcyclists are treated differently in New York
This is the exception that surprises people most: motorcyclists are not covered by New York's no-fault system. A rider does not get automatic medical and wage benefits the way a driver or passenger in a car does, and does not have to meet the serious injury threshold to bring a claim against the at-fault driver.
In practice that means your medical treatment is more likely to run through your health insurance, and the claim against the driver is the main route to recovery. It also means there is no 30-day no-fault clock, though the ordinary three-year deadline still applies.
Riders face a particular problem with perception. Insurers and juries often start from an assumption that the motorcyclist was speeding or weaving. How long you have to file
In New York the general deadline for a personal injury claim is three years from the date of the injury. Several exceptions are much shorter — a claim against the City, the MTA or another public body usually requires a notice of claim within 90 days, and wrongful death has its own two-year limit. Because the short deadlines are the easy ones to miss, it is worth a call early even if you have not decided whether to bring a claim.
Common questions
Does no-fault cover me on a motorcycle?
Generally no. New York excludes motorcyclists from no-fault benefits, which is why treatment often runs through health insurance and why the claim against the at-fault driver carries more weight.
Do I have to meet the serious injury threshold?
Because motorcyclists are outside no-fault, the threshold generally does not apply to a rider's claim in the way it does for someone injured in a car. That is a meaningful difference.
I was not wearing a helmet on a road where it is required. What happens?
New York requires helmets for motorcyclists. Not wearing one can be raised in relation to head injuries and may reduce recovery, but it does not by itself end a claim for other injuries.
What if the accident was partly my fault?
New York uses pure comparative negligence. Your compensation is reduced by your share of the fault rather than barred outright, so even someone substantially at fault may still recover. It is worth having someone look at it before you assume otherwise.
