How long you have to file
A product injury claim generally follows New York's three-year deadline, though claims involving exposure to a toxic substance may run from the date of discovery instead. Because the analysis differs and evidence degrades, early advice is particularly valuable here.
Common questions
I threw the product away. Is my case over?
Not necessarily, but it is significantly harder. Photographs, the model and serial number, purchase records, recall notices and other examples of the same product can all help. It is still worth a conversation.
The product was recalled. Does that mean I win?
A recall is helpful evidence but it is not automatic proof of liability in your case. You still have to show the defect caused your injury.
I was using it at work. Does that change things?
It may open two routes rather than one — a workers' compensation claim, and a separate product claim against the manufacturer, which is not limited in the way a claim against your employer is.
What if the accident was partly my fault?
New York uses pure comparative negligence. Your compensation is reduced by your share of the fault rather than barred outright, so even someone substantially at fault may still recover. It is worth having someone look at it before you assume otherwise.
