Cyclists have more coverage than most riders realise
If you were riding a bicycle and were struck by a motor vehicle, you are generally covered by that vehicle's no-fault insurance for your medical treatment and part of your lost earnings — even though you were not in a car. How long you have to file
In New York the general deadline for a personal injury claim is three years from the date of the injury. Several exceptions are much shorter — a claim against the City, the MTA or another public body usually requires a notice of claim within 90 days, and wrongful death has its own two-year limit. Because the short deadlines are the easy ones to miss, it is worth a call early even if you have not decided whether to bring a claim.
Common questions
I was not wearing a helmet. Does that end my claim?
No. For adult riders New York has no general helmet requirement, and not wearing one does not bar a claim. It may be raised in relation to head injuries specifically, which is one reason the medical evidence matters.
Does no-fault really cover me on a bicycle?
If a motor vehicle was involved, generally yes — the vehicle's no-fault coverage applies to the cyclist it struck. The application deadline is 30 days, so this is worth acting on quickly.
What if the driver left the scene?
There may still be a route to recovery, including through uninsured motorist coverage on a policy in your household. These claims carry their own notice requirements and should be looked at early.
What if the accident was partly my fault?
New York uses pure comparative negligence. Your compensation is reduced by your share of the fault rather than barred outright, so even someone substantially at fault may still recover. It is worth having someone look at it before you assume otherwise.
