When the driver is never found, people often assume that is the end of it. Frequently it is not. Uninsured motorist coverage on your own policy — or on a policy held by a relative in your household — is designed for exactly this situation, and it can respond to a hit and run.

New York also has the Motor Vehicle Accident Indemnification Corporation, MVAIC, for people with no available insurance at all. Its deadlines are short and strict: broadly, a police report within 24 hours where practicable and a notice of intention within 90 days. Missing them can close the door.

Report the incident to the police immediately and get the report number. Any detail you remember about the vehicle helps, and nearby businesses and homes often have cameras — that footage is usually overwritten within days.

How long you have to file

The ordinary three-year deadline still applies to a personal injury claim, but the routes that matter in a hit and run have far shorter clocks. I did not report it to the police straight away.

It makes things harder, particularly for an MVAIC claim, but it does not automatically end every route. Report it as soon as you can and get advice on what remains open.

What is MVAIC?

The Motor Vehicle Accident Indemnification Corporation. It exists to compensate qualifying New York residents injured by uninsured or unidentified drivers where no other coverage is available. Its requirements are strict and time-limited.

The insurer already offered me money. Should I take it?
