Where We Serve

Truck Accident Lawyer in Throgs Neck, NY

Start with the file, because the file came first. A carrier operating over the Throgs Neck Bridge has to hold a qualification record for the driver, a maintenance history for the tractor, an inspection record for the trailer, and an electronic account of every hour that driver spent on duty. All of it exists before a crash and independently of one. That is the structural difference between a collision with a commercial vehicle and a collision with a neighbor's car. And then there is the other half, which no regulation covers: a person in an emergency room on Pelham Parkway South trying to work out what happens next.

Why a Truck Claim Is Built Differently

Two things change when the other vehicle is commercial. The first is the rulebook. A federal safety code sits on top of state traffic law and imposes obligations on the company as well as the driver, from screening at hiring to drug and alcohol testing under 49 CFR Part 382. The second is scale. A loaded tractor-trailer needs far more distance to stop than the car behind it, which is why following distance under Vehicle and Traffic Law §1129 is a recurring issue in these cases and why the injuries tend to be more severe. Our truck accident team approaches the two questions together.

Interstates, Service Roads and Bridge Approaches

Truck traffic here runs on the Throgs Neck Expressway (I-295), the Cross Bronx Expressway (I-95), the Bruckner Expressway, Bruckner Boulevard and East Tremont Avenue. The neighborhood sits where two interstates meet a major toll bridge that carries commercial vehicles, and Hunts Point market traffic uses the Bruckner corridor nearby. Service-road merges happen at highway speed, which leaves very little room to recover from a misjudged gap.

The places that come up again and again are East Tremont Avenue at the Throgs Neck Expressway service roads, Bruckner Boulevard at Brush Avenue, East Tremont Avenue at Randall Avenue, and the Cross Bronx and Bruckner interchange. Elsewhere on local streets, the city's truck route rules limit where a trailer may legally travel, and a truck off route is a fact worth pinning down.

Evidence With an Expiration Date

Data does not wait for a claim to get organized. Duty status records kept on an electronic logging device are retained for a limited period. Forward-facing camera footage frequently overwrites itself within days. Telematics, dispatch messages and repair tickets sit in systems with their own purge cycles. A written preservation letter to the carrier and its insurer asks that all of it be held, and it creates a record of the request if material later goes missing. Sending one within days rather than months is often the single most useful early step in a case like this.

The Duty Cycle Behind the Wheel

The federal limits are specific. Ten consecutive hours off duty, then up to 11 hours of driving, all inside a 14-hour window that keeps running through loading and traffic. A 30-minute break after 8 cumulative driving hours. A rolling ceiling of 60 hours over 7 days or 70 over 8. The published summary lays out the exceptions that apply to short-haul and adverse conditions. Because most of this is now recorded automatically, the question of whether a driver should have been working at that hour has an answer in the data rather than in anyone's account of the day.

The First Days After a Throgs Neck Crash

The NYPD 45th Precinct on Barkley Avenue covers this area and prepares the report. Jacobi Medical Center on Pelham Parkway South is the Level 1 trauma center nearby. Go, and keep going to the follow-ups, because gaps in treatment get used against injured people more often than anything else. Federal safety guidance is a fair reminder of how much of a serious injury is not visible at the roadside.

If you can do it safely, photograph the door lettering and USDOT number, the trailer markings, the lane positions and the debris field. Ask a passenger or a bystander to note where vehicles came to rest. A spine injury in particular can present mildly on day one and change substantially by the second week.

Deadlines, and Where the Case Gets Filed

Most injury actions carry a three-year limit under CPLR §214, and a death claim brought by an estate runs under EPTL §5-4.1 on its own shorter schedule. Venue follows where the crash happened and where the parties live or do business, which matters unusually much on this peninsula: a collision on a Queens-side bridge approach, or one involving a Queens-based carrier, can properly belong in Queens County Supreme Court rather than in Bronx County on the Grand Concourse. Settling that question early avoids a wasted filing.

When the Adjuster Calls First

Large carriers investigate immediately. It is common for an adjuster, and sometimes an accident reconstruction team, to be working the same day, well before an injured person has left the hospital. That is not misconduct, it is preparation, and it is a reason not to give a recorded statement or sign a medical authorization before you understand what you are agreeing to. David Cohen or Benjamin Davidov can take those calls instead, and more general questions are answered on our FAQ page.

Common questions

My crash was on the bridge approach. Which county hears the case?

It depends on exactly where the collision occurred and on where the parties reside or maintain a place of business. A crash on the Bronx side generally points to Bronx County, while one on the Queens-side approach, or involving a Queens-based driver or carrier, can land in Queens County Supreme Court. Because the boundary runs through the bridge, the precise location is worth documenting rather than approximating.

Can a commercial truck legally be on a parkway near here?

No. Commercial vehicles are banned from New York City and Long Island parkways, and low parkway bridges are struck by overheight trucks with some regularity. A trailer on a parkway is off route by definition, and where the route came from a dispatcher rather than the driver, that decision can be part of the claim.

What should I do if the trucking company asks for a recorded statement?

You are under no obligation to give one to the other side's insurer. Early statements are taken before treatment has revealed the full extent of an injury, and the transcript tends to follow the case for years. It is reasonable to decline politely, provide only identifying information, and refer further questions to a lawyer.
