Truck Accident Lawyer in Bayside, NY
The Long Island Expressway service roads carry the trucks that the Cross Island Parkway will not take. Commercial vehicles are barred from the parkway, so the freight that would otherwise use it is pushed onto the LIE and the Clearview instead, and from there onto Northern Boulevard, Francis Lewis Boulevard and Springfield Boulevard. Every one of those exits ends in a neighborhood street. The person hurt in that transition is usually somebody doing something ordinary, a left turn near 26th Avenue or a walk down Bell Boulevard, and this page is written for them.
Bayside's Truck Geography
The corridors that carry commercial weight here are the Long Island Expressway (I-495) service roads, Northern Boulevard, the Clearview Expressway (I-295), Francis Lewis Boulevard and Springfield Boulevard. The parkway ban is the fact that shapes the rest. Because trucks cannot use the Cross Island, drivers relying on a navigation app that does not know the difference sometimes end up on it anyway, and the corrections they make are abrupt: sudden merges, unexpected stops, and at the low parkway overpasses, overheight strikes. The city's truck route map shows which roads are actually open to them.
The locations that generate the most calls are Bell Boulevard and Northern Boulevard, Francis Lewis Boulevard and 26th Avenue, the Clearview Expressway service roads near the LIE, and Springfield Boulevard at the Horace Harding Expressway. Bell Boulevard adds its own pattern, since a nightlife strip and a delivery street occupy the same blocks at different hours.
A Different Set of Rules Applies to the Other Driver
When the vehicle that hit you was commercial, a federal framework attaches to it that has no counterpart in an ordinary collision. The Federal Motor Carrier Safety Administration requires carriers to qualify their drivers, document their maintenance, and record their duty hours. Those requirements generate paper. Commercial insurance also tends to sit at higher limits than a personal auto policy, and the trip usually involves several businesses rather than one person. That is the practical distinction our truck accident practice is built on, and you can see the rest of what we handle on our practice areas page.
Duty Hours and the Electronic Log
The hours-of-service limits are specific. A property-carrying driver may drive up to 11 hours after 10 consecutive hours off duty, and only within a 14-hour on-duty window that does not pause for breaks. A 30-minute break is required after 8 cumulative hours of driving, and a rolling limit of 60 hours in 7 days or 70 hours in 8 days caps the week. 49 CFR Part 395 contains the full rule. Since December 2017 most carriers have had to capture duty status electronically, which means the log is a dataset with timestamps rather than a handwritten page, and it can be compared against fuel receipts, dispatch records and toll data.
The First Week After a Bayside Crash
- Get checked even if you feel able to walk away. Long Island Jewish Medical Center in New Hyde Park is a Level 1 trauma center a few minutes east.
- The NYPD 111th Precinct at 45-06 215th Street covers Bayside and will normally generate the report.
- Note the company name, the USDOT number and any lettering on the trailer doors.
- If the truck was on a road it should not have been on, say so to the responding officer while it is fresh.
- Start a simple daily note about pain, sleep and the tasks you cannot do yet.
Where No-Fault Stops Being the Whole Story
New York's no-fault system, set out in Insurance Law §5103, pays your early medical treatment and a portion of lost earnings without asking who caused the crash. It also limits when you can sue, unless your injury meets the serious injury definition in Insurance Law §5102. Truck collisions clear that threshold considerably more often than low-speed car crashes, which is what moves a case from a benefits claim into a liability claim against the carrier and its insurer.
If Someone Says You Share the Blame
Insurers frequently argue that the injured person contributed to the crash. In New York that argument does not end a claim. Under CPLR §1411, comparative fault reduces a recovery in proportion to the injured person's share of responsibility rather than barring it. Separately, Vehicle and Traffic Law §1129 requires every driver to keep a reasonable and prudent distance, and a loaded truck needs considerably more of it than the car behind you does.
What a Claim May Cover
Depending on the injuries, a claim can address medical treatment already received and reasonably expected in the future, earnings lost while recovering and any lasting reduction in earning capacity, out-of-pocket costs, and the physical pain and the loss of ordinary activity that follow a serious injury. A spouse may have a separate claim for loss of services. None of that is a formula, and no lawyer can tell you a number at the first meeting. What we can do is document each category properly and in the right order.

Common questions
The truck was on the Cross Island Parkway, where trucks are not allowed. Does that help my case?
It is relevant. A commercial vehicle operating on a roadway closed to it is a fact worth establishing early, and it often connects to other questions about routing, dispatch instructions and what the driver was told about the trip. It does not decide liability by itself, but it tends to shape how the rest of the investigation goes.
An overheight truck struck a parkway bridge near me. Who handles that kind of claim?
Bridge strikes usually involve a routing failure rather than a momentary driving error, so the inquiry moves quickly toward the carrier and whoever planned the trip. Clearance information is public, load height is documented, and the equipment specifications are on file. Those cases are investigated as commercial claims from the start.
How long do I have to bring a truck accident claim in New York?
Most personal injury claims carry a three-year deadline from the date of the crash, and shorter notice requirements apply when a public entity is involved. Because those rules vary with the parties, it is worth confirming your specific dates early rather than assuming the longest one applies to you.
