Car Accident Lawyer in Oakland Gardens, NY
Oakland Gardens is boxed in by highways. The Long Island Expressway runs along its northern edge, the Clearview Expressway sits just to the west, and the Cross Island Parkway and Alley Pond Park close it off to the east. The streets in between are residential and calm. The crashes happen where expressway traffic spills onto them.

Expressway Traffic on Neighborhood Streets
Community Board 11 describes Oakland Gardens as the area south of the Long Island Expressway and north of 73rd Avenue, from Oceania Street to the Cross Island Parkway. That makes almost every trip in or out of the neighborhood pass through one of a few pinch points.
- The Horace Harding service roads at Springfield Boulevard. Cars leaving the LIE decelerate onto the service road and meet traffic turning onto Springfield Boulevard, the neighborhood's main north–south street. Merging and sideswipe collisions are the familiar pattern.
- Springfield Boulevard and 73rd Avenue. Two bus routes meet here — the Q27 on Springfield and the Q88, which runs along the Horace Harding Expressway, 73rd Avenue and Springfield Boulevard. Buses stopping and pulling out of the curb lane create the same blind spots on every trip.
- Springfield Boulevard at Union Turnpike. Just south of the neighborhood, where the Q27 and Q88 meet the Q46. Fast traffic on both roads and riders crossing to make the transfer.
- School traffic on Springfield Boulevard. Benjamin N. Cardozo High School and Queensborough Community College sit just north of the expressway, and students and staff cross the service roads in waves at the start and end of the school day.
There is no subway in Oakland Gardens, so most people here drive or ride the bus — which means a lot of people waiting at curbside stops next to fast traffic. If a car struck you while you were on foot, read our pedestrian accident page; the claim follows different rules than a collision between two cars.
Right After the Crash
Two hospitals are close. Long Island Jewish Medical Center, a short drive east, is a state-designated Level I trauma center. NewYork-Presbyterian Queens in Flushing is the other common destination. Whichever you go to, go soon: insurers read a gap between the crash and your first visit as a sign the injury came from somewhere else.
The NYPD 111th Precinct at 45-06 215th Street in Bayside covers Oakland Gardens. Crashes on the LIE mainline itself may be handled by a highway unit rather than the precinct, so note who responded and get the incident number either way. Take photos before the cars are moved if it is safe — on a service road, skid marks and the final position of the cars disappear within minutes.
Ordering the Report
The precinct does not hand out copies. You request the report from the state through the DMV's crash report service, and it typically becomes available in a couple of weeks. When no officer came and someone was injured, file the MV-104 yourself within ten days. Check the diagram in particular: on a service road, the report sometimes puts the collision on the expressway or the wrong side of the median, and that changes the story.
Who Pays for What
New York's no-fault system means your own policy pays first — medical treatment and a portion of lost earnings, up to the policy's limits — under Insurance Law §5103. You must apply within thirty days. Pain and suffering, and losses above the no-fault limits, come from the at-fault driver's insurance, but only if the injury meets the "serious injury" definition in Insurance Law §5102(d). A highway-speed collision at a service road merge is the kind of crash that can produce them.
Shared fault is common in merge crashes, where each driver says the other changed lanes. CPLR §1411 reduces a recovery by your percentage of fault. Since a 2026 amendment, a motor-vehicle injury claim is barred if your share of the fault is greater than the other side’s; that rule governs any lawsuit filed on or after May 26, 2026, even if the accident happened earlier. That makes early evidence — dashcam video, a witness at the bus stop, the damage pattern on both cars — worth more than usual.
Deadlines and the Courthouse
Most claims against another driver must be filed within three years under CPLR §214. If a city vehicle, an MTA bus or a road defect played a part, a notice of claim is due within 90 days, and missing it can end the claim. A lawsuit from Oakland Gardens goes to Queens County Supreme Court, Civil Term at 88-11 Sutphin Boulevard in Jamaica.

Common questions
My crash was on the LIE itself, not a local street. Does that change anything?
The basic claim is the same — no-fault, then the at-fault driver if the injury is serious enough. The differences are practical: a different police unit may write the report, and expressway crashes more often involve several vehicles, which makes sorting out fault and insurance coverage more involved.
I was hit while waiting at a bus stop on Springfield Boulevard. Who is responsible?
Usually the driver who hit you, and their insurance. If you were not in a vehicle, you may also be able to claim no-fault benefits through a policy in your household or the vehicle that struck you. We sort out which policy applies.
Do I need to hire a lawyer right away?
Not necessarily, but the early weeks are when evidence is easiest to collect and the thirty-day no-fault deadline is running. A free call costs nothing and can tell you whether there is anything urgent to do.
