Where We Serve

Slip and Fall Lawyer in Jamaica, NY

Downtown Jamaica is full of people on foot: shoppers along Jamaica Avenue, commuters changing between the LIRR, the subway, buses and the AirTrain, and everyone heading to the courthouses and government offices around Sutphin Boulevard. With that much foot traffic, falls are common — and in Jamaica, who owns the stairs or the floor where you fell can be the difference between a three-year deadline and a two-month one.

Transit Falls: Three Different Owners

The transit hub around Sutphin Boulevard and Archer Avenue looks like one place, but it is owned and run by different authorities, each with its own rules.

  • Jamaica Station (LIRR). The Long Island Rail Road is part of the MTA. A claim requires a notice of claim within 90 days, and the deadline to sue is shorter than three years.
  • The subway (E, J and Z). Stations such as Sutphin Boulevard–Archer Avenue and Jamaica Center are run by the New York City Transit Authority. A notice of claim is due within 90 days, and a lawsuit within one year and 90 days.
  • The AirTrain JFK. The AirTrain is operated by the Port Authority of New York and New Jersey. Suits against the Port Authority must be started within one year, and a sworn notice of claim must be served at least 60 days before suit is filed — a different structure from the City's rules.

Falls in stations often involve wet stairs and floors near entrances, worn or broken stair nosings, escalators that stop suddenly, and crowded platforms. Note exactly where you fell, keep your fare receipt or card history, and report the fall to station staff.

Jamaica Avenue Shopping

The Jamaica Avenue shopping district runs for blocks with national chains, local stores, indoor malls and street vendors. Inside a store, the owner must keep floors reasonably safe; you generally need to show the owner created the hazard, knew about it, or should have found it. Spilled liquids, rain tracked in at entrances without mats, cluttered aisles and broken steps are the usual causes. Outside, the owner of a commercial building is responsible for the sidewalk in front of it under Administrative Code §7-210, including cellar doors and grates set into it.

Public Buildings and Parks

Downtown Jamaica is home to many government buildings. Falls in a City-owned building, on a City sidewalk or in a park such as Rufus King Park are claims against the City, which require a notice of claim within 90 days under General Municipal Law §50-e. A fall in a State building is a claim in the New York Court of Claims, also on a 90-day timetable. A fall in a federal building is governed by the Federal Tort Claims Act.

Escalators, Elevators and Sidewalk Clutter

Two kinds of falls are more common downtown than elsewhere in Queens. The first involves escalators and elevators — an escalator that jerks or stops suddenly, or an elevator that stops a few inches above or below the floor. The building or station owner is responsible, and so, often, is the company hired to maintain the equipment; its service records can show whether problems had been reported. The second involves the sidewalk itself: merchandise, display racks, cords and boxes set out by stores and vendors along Jamaica Avenue that narrow the walkway or catch a foot. The business that put them there can be responsible, and so can the property owner whose sidewalk it is. Photograph the obstruction and the storefront before anything is moved.

Comparative Fault

If you were distracted or rushing, that does not end your claim. Under CPLR §1411, your recovery is reduced by your share of responsibility. The 2026 amendment that bars mostly-at-fault claimants applies only to motor-vehicle cases.

After the Fall

Jamaica Hospital Medical Center on the Van Wyck is a state-designated Level I trauma center, and Queens Hospital Center on 164th Street is nearby. Get treated the same day if you can. Then photograph the spot, collect witnesses' names, and ask for an incident report from the store or station. Downtown Jamaica is in the NYPD's 103rd Precinct.

Deadlines and the Court

Claims against private owners and stores generally must be filed within three years under CPLR §214. Transit and government claims have the shorter deadlines described above. Cases are filed at Queens County Supreme Court, Civil Term at 88-11 Sutphin Boulevard, steps from the transit hub.

Common questions

I fell on the stairs between the AirTrain and the LIRR. Which authority do I claim against?

It depends on exactly where you fell, because the Port Authority and the MTA each own different parts of the complex. That is worth figuring out quickly, since the notice rules differ and both are short.

I slipped on a wet floor in a store on Jamaica Avenue. Do I need to prove how long the spill was there?

Often, yes, unless the store created the spill. Camera footage, employee statements and the condition of the spill — tracks, dirt, how dry it was at the edges — are common ways to show it had been there long enough.
