Car Accident Lawyer in Briarwood, NY
Briarwood is a small neighborhood with a highway on one side and a hospital campus on the other. The Van Wyck Expressway forms its western edge, Queens Boulevard and Main Street meet at its subway station, and Hillside Avenue runs along its southern border. Commuters pass through Briarwood on all of them, and that is where most of its collisions happen.

Briarwood's Problem Roads
The neighborhood sits between Union Turnpike on the north and Hillside Avenue on the south, from the Van Wyck Expressway east to Parsons Boulevard.
- Queens Boulevard and Main Street. The Briarwood station on the E and F lines sits under this junction. The Q60 runs on Queens Boulevard and the Q20 and Q44 Select Bus Service run on Main Street, so buses, subway riders and drivers heading for the Van Wyck all converge on a few hundred feet of road.
- The Van Wyck service roads. In recent years the state has been rebuilding and widening the Van Wyck between the Kew Gardens Interchange and JFK Airport, including reconstructing overpasses and relocating exit ramps south of Hillside Avenue. Work zones bring narrowed lanes, shifted ramps and sudden slowdowns, and drivers leaving the expressway onto local streets do not always adjust their speed.
- Hillside Avenue. The F train stops at Sutphin Boulevard and Parsons Boulevard below Hillside, and the avenue carries heavy bus and car traffic toward downtown Jamaica. Riders crossing to the station entrances and buses re-entering traffic are the recurring hazards.
- Union Turnpike and Parsons Boulevard. A wide intersection at the neighborhood's northeast corner, where Union Turnpike traffic meets drivers cutting down Parsons toward Hillside Avenue.
School traffic adds to it. Archbishop Molloy High School and M.S. 217 bring large numbers of students onto Briarwood's side streets twice a day. If a car struck you while walking, our pedestrian accident page explains how that kind of claim works.
Right After a Briarwood Crash
Queens Hospital Center sits just east of the neighborhood, and Jamaica Hospital Medical Center on the Van Wyck is a state-designated Level I trauma center. Get evaluated soon after the crash; insurers treat a delay in seeing a doctor as evidence that you were not really hurt, or that something else hurt you.
Briarwood is in the NYPD 107th Precinct, headquartered at 71-01 Parsons Boulevard. A crash on the Van Wyck itself may be handled by a highway unit. Either way, get the officers' names and the incident number, and photograph any work-zone signs, barrels or lane shifts near the crash before conditions change.
Report and Records
Order the crash report through the New York DMV, not the precinct. If police did not come and someone was injured, the drivers file an MV-104 themselves within ten days. In a work-zone crash, the construction contractor's traffic-control plans and daily logs can matter, and we request them when the layout of the lanes may have played a part.
Paying the Medical Bills
New York's no-fault coverage, under Insurance Law §5103, pays medical expenses and part of lost wages through your own policy, whoever caused the crash. The application must be filed within thirty days. To bring a claim against the other driver for pain and suffering, the injury must meet the serious injury threshold in Insurance Law §5102(d), which is proven through medical records and objective findings rather than a description of pain alone.
Shared Fault and Work Zones
When lanes shift unexpectedly, drivers often blame each other and the road. Fault can be divided under CPLR §1411, which reduces a recovery by your percentage of responsibility. Since a 2026 amendment, a motor-vehicle injury claim is barred if your share of the fault is greater than the other side’s; that rule governs any lawsuit filed on or after May 26, 2026, even if the accident happened earlier. If poorly placed signs or an unsafe lane configuration contributed, a contractor or a public agency may share responsibility, and claims against a public agency have short deadlines.
Deadlines and the Court
A lawsuit against another driver must usually be filed within three years under CPLR §214. A claim involving a city or state agency, an MTA bus or a public roadway defect starts with a notice of claim, generally within 90 days. Briarwood cases are heard at Queens County Supreme Court, Civil Term at 88-11 Sutphin Boulevard, a short ride from Briarwood.

Common questions
My crash happened in the Van Wyck construction zone. Can the construction company be responsible?
It can, if the way the work zone was set up — signs, barriers, lane markings, lighting — helped cause the crash. That is a separate question from the other driver's fault, and it depends on records the contractor and the state keep, so it is worth raising early.
I was a passenger on the Q60 when it stopped short. Do I have a claim?
Possibly. A bus passenger injured by a sudden stop may have a claim if the stop was caused by careless driving. Claims involving MTA buses require a notice of claim within 90 days, so the deadline is short.
The other driver's insurer called me. Should I give a recorded statement?
You do not have to, and it is usually better to speak with a lawyer first. Statements given in the first days after a crash, before you know the full extent of your injuries, are often used to minimize a claim.
