Car Accident Lawyer in Auburndale, NY
Auburndale is mostly quiet residential blocks between Flushing and Bayside, but two of its boundaries are expressways and one of its main streets is Northern Boulevard. When a crash happens here, it is usually on one of the commercial strips or at the ramps where expressway traffic comes down into the neighborhood.

Where Auburndale Collisions Happen
Community Board 11 places Auburndale between Utopia Parkway on the west and the Clearview Expressway on the east, from 26th Avenue south to the Long Island Expressway. Its commercial life is on two streets — Northern Boulevard and Francis Lewis Boulevard — and that is where the traffic concentrates.
Northern Boulevard and Francis Lewis Boulevard. The intersection where the neighborhood's two commercial strips cross. The Q12 and Q13 run along Northern Boulevard and the Q76 along Francis Lewis. Turning traffic, shoppers parking along the curb and buses pulling in and out make it a busy and unforgiving corner.
The Clearview Expressway ramps. Along the eastern edge, drivers come off the Clearview onto Northern Boulevard and the side streets, often still at highway speed. Merges and failures to yield at the ramp ends are a familiar pattern.
Utopia Parkway and the LIE service roads. At the southern edge, Utopia Parkway crosses the Long Island Expressway's service roads. Francis Lewis High School sits on Utopia Parkway north of the expressway, so the area fills with students at the start and end of the school day.
Around the Auburndale LIRR station. The Port Washington Branch stops at Auburndale, and commuters walk to and from the station at rush hour on residential streets without many signals. People hit while walking have a different kind of claim; our pedestrian accident practice covers it.
The First Steps
Auburndale is covered by the NYPD 111th Precinct at 45-06 215th Street in Bayside. Call 911 if anyone is hurt. Exchange license, registration and insurance information, and take pictures of the documents, the vehicles before they are moved, and the traffic signals or signs at the corner. Stores along Northern Boulevard often have cameras; ask the store to keep the footage, because many systems record over it within days.
NewYork-Presbyterian Queens in Flushing is the closest hospital. Go even if you think you are fine — a medical record made soon after the crash is the most useful evidence of what the crash did to you.
Getting Your Report
Reports are ordered through the state's DMV crash report service, typically a couple of weeks after the crash. If no officer responded and someone was hurt, each driver must submit an MV-104 within ten days. Read the officer's narrative closely; it is often based on a few minutes of conversation at the scene.
How Medical Bills and Lost Wages Are Covered
No-fault insurance under Insurance Law §5103 means your own carrier pays your medical bills and part of your lost earnings, regardless of fault. You have thirty days to apply. Beyond that, a claim against the at-fault driver can cover pain and suffering and losses no-fault does not pay, if the injury is serious under Insurance Law §5102(d). Many cases turn on that threshold, which is why following through with treatment matters.
When the Other Driver Blames You
Ramp merges and turns across a busy boulevard produce a lot of "you came out of nowhere" disputes. CPLR §1411 reduces a recovery by your percentage of fault. Since a 2026 amendment, a motor-vehicle injury claim is barred if your share of the fault is greater than the other side’s; that rule governs any lawsuit filed on or after May 26, 2026, even if the accident happened earlier. Camera footage from Northern Boulevard businesses and the damage pattern on the cars often settle these arguments.
Deadlines and the Courthouse
The usual deadline to sue another driver is three years under CPLR §214. When a public vehicle, an MTA bus or a road defect is part of the story, a notice of claim is due within 90 days. An Auburndale case is filed at Queens County Supreme Court, Civil Term at 88-11 Sutphin Boulevard in Jamaica.

Common questions
I was hit at the bottom of a Clearview Expressway ramp. Is the state responsible because it is a state highway?
Usually the claim is against the driver who hit you. A highway authority becomes relevant only if a defect in the road or its signs helped cause the crash, and claims against public agencies carry short notice deadlines, so mention it early if you think the road played a part.
The driver who hit me was in a delivery van. Does that change anything?
It can. A commercial vehicle usually carries its own policy, and the company that owns it may also be responsible for its driver. Write down the company name and any vehicle number you saw.
How long will my case take?
It depends mostly on your medical recovery. A claim generally should not be settled until the extent of the injury is known, which can take months. We can tell you more once we understand your injuries and the insurance involved.
