Each has the same underlying problem: a truck making a wide turn from a road built for through traffic into a grid built for houses, with a signal cycle that assumes everyone accelerates like a car.

If Someone Says You Were Partly at Fault
New York applies pure comparative fault under CPLR §1411. Being assigned a share of responsibility reduces what you recover in proportion, but it does not bar a claim. Insurers raise the argument routinely, particularly near the county line where lane changes and merges are constant.
